Agreement and operator
These Terms of Use ("Terms") are a binding agreement between you and GPGA Technologies, Inc. ("GPGA," "we," "us," or "our"), operator of the Trusti brand and services.
By accessing trustiscore.com, creating or using a Trusti account, purchasing a Trusti plan, submitting an application for a pilot or using a Trusti product or service, you agree to these Terms and acknowledge our Privacy Policy.
Additional terms may apply to a particular product, pilot, organizational engagement, paid plan or other Trusti experience. If specific written terms conflict with these general Terms regarding the subject matter they govern, the specific written terms control for that subject matter.
Eligibility and authority
Unless GPGA expressly approves a different arrangement under applicable program terms, you must be at least 18 years old or the age of legal majority where you live to create a Trusti account, purchase a plan or participate directly in a Trusti Business pilot.
You must have lawful authority to provide or authorize the evaluation of any email address, domain, account, organization, system or other information submitted to Trusti.
If you act for an organization, you represent that you have authority to act for that organization for the applicable Trusti purpose.
Trusti services and product stage
Trusti may include:
- Trusti Score;
- Improvement Hub;
- Trusti Verified;
- Trusti Business;
- Trusti Compliance Check;
- Trusti Compare;
- Authorized Context capabilities;
- educational materials;
- early-access experiences;
- pilots; and
- other related services introduced over time.
Some capabilities may be illustrative, experimental, in development, limited to selected users or organizations, or unavailable in certain locations.
Trusti methodologies may be versioned and may evolve as products, evidence, data quality and our systems improve.
Features, methodology versions, availability, eligibility, product names and pricing may change over time, subject to applicable law and any specific agreement with you.
Informational nature; no consumer report
Trusti Scores and related outputs are informational readings of digital condition based on available, permitted and authorized signals.
They are not:
- credit scores or credit ratings;
- consumer reports or investigative consumer reports;
- insurance underwriting decisions;
- employment decisions;
- housing decisions; or
- other eligibility determinations regulated by the U.S. Fair Credit Reporting Act or similar law.
GPGA is not a consumer reporting agency.
You may not use Trusti, a Trusti Score, a Trusti verification or an Authorized Context result to determine eligibility for credit, housing, employment, insurance or another purpose where use would cause Trusti or GPGA to operate as a consumer reporting agency or would otherwise violate applicable law.
Authorization by a Trusti user to share a limited result does not authorize the recipient to use that result for a prohibited or unlawful eligibility decision.
No professional, insurance or regulatory advice
Trusti services provide informational digital-condition tools and related functionality.
They do not provide legal, financial, insurance, employment, regulatory, compliance, security or other professional advice.
Trusti outputs do not constitute:
- an insurance product;
- an insurance underwriting decision;
- a promise or guarantee of coverage;
- legal or regulatory advice;
- a regulatory certification;
- a professional audit;
- a guarantee that an incident will or will not occur; or
- a substitute for professional judgment where professional advice is required.
You remain responsible for decisions that require legal, financial, insurance, employment, compliance, security or other specialized expertise.
Trusti products and Authorized Context
Trusti Verified
Trusti Verified, when available, may confirm limited conditions, scope, evaluation status or validity associated with a Trusti result. A Verified status does not certify a person or organization generally and does not guarantee future condition, performance or eligibility.
Trusti Business
Trusti Business provides an organizational reading based on signals, evidence and conditions relevant to the organization and the authorized scope being evaluated. A Trusti Business Score is an organizational result and is not an aggregation or average of Personal Trusti Scores.
Each organization remains responsible for its own policies, controls, actions and decisions.
Trusti Compliance Check
Trusti Compliance Check may organize observable controls, evidence and relevant conditions to help an organization understand its current position. It does not replace a formal audit, legal opinion, regulatory certification or professional compliance assessment.
Trusti Compare
Trusti Compare may present compatible options, contextual information or comparisons when available. It does not guarantee eligibility, approval, pricing, discounts, employment, credit, insurance coverage or contractual terms offered by another party.
Authorized Context
Authorized Context allows limited Trusti information to be used within a defined organizational purpose and scope when the relevant person has authorized that use.
Depending on the capability involved, an authorized organization may receive a limited validation containing information such as a Score, condition, evaluation date, validity period, purpose and selected shared dimensions.
Authorized Context:
- does not merge a Personal Trusti Score with a Trusti Business Score;
- does not transfer ownership of the Personal Trusti Score to an organization;
- does not by itself authorize access to passwords, private account contents or a person’s complete digital history; and
- may not be used for a prohibited or unlawful eligibility decision.
Accounts, security and authorization
You agree to:
- provide accurate and current information;
- protect your credentials, devices and authentication methods;
- promptly notify GPGA if you become aware of unauthorized access;
- submit or evaluate only systems, accounts, domains, emails and information that you are authorized to use for the applicable purpose; and
- comply with applicable notices, consent requirements and laws when information concerns another person.
You may not provide another person’s sensitive or private information without lawful authority and any required notice or consent.
Acceptable use
You may use Trusti only for lawful and authorized purposes. You may not:
- attempt to access accounts, systems or information without authorization;
- bypass technical or security controls;
- interfere with or disrupt Trusti;
- introduce malware or harmful code;
- scrape, crawl or use automated extraction methods except where GPGA expressly permits them;
- reverse engineer or attempt to derive proprietary Trusti methodology, algorithms, scoring logic or internal controls except where applicable law expressly permits such activity;
- use Trusti outputs to discriminate, harass, deceive or make unlawful decisions;
- use Trusti for a prohibited eligibility purpose described in Section 4;
- misrepresent, alter or falsify a Trusti Score, validation, verification, pilot status or relationship with GPGA;
- upload information that violates law or another person’s rights; or
- resell, sublicense or commercially exploit Trusti without GPGA’s written authorization.
Information you provide and feedback
You retain ownership of information you provide to Trusti.
You grant GPGA a limited, non-exclusive right to host, store, reproduce, analyze, process, transmit and display that information only as reasonably necessary to provide and operate the applicable Trusti service; secure and support Trusti; generate requested outputs; comply with applicable law; enforce these Terms; and improve Trusti in accordance with our Privacy Policy.
GPGA may use aggregated or de-identified information that no longer reasonably identifies an individual as described in our Privacy Policy.
If you voluntarily provide suggestions, ideas or general product feedback, you grant GPGA a worldwide, perpetual, royalty-free right to use that feedback to improve or develop Trusti without obligation to compensate you.
You should not include another person’s sensitive personal information, confidential business information or information you are not authorized to disclose in general product feedback.
Intellectual property
Trusti names, logos, trademarks, software, interfaces, methodology, scoring systems, documentation, designs, content and other proprietary materials are owned by GPGA or its licensors and are protected by applicable intellectual-property laws.
These Terms grant you only a limited right to access and use Trusti for its intended purpose. No ownership rights in Trusti intellectual property, methodology or software are transferred to you.
Plans, billing, renewals and cancellation
Trusti may offer free, one-time, recurring, pilot or other paid arrangements.
The pricing, billing frequency, renewal terms and material purchase conditions applicable to a paid service will be presented through the applicable checkout, order form, pilot agreement or other purchase flow.
If a checkout or agreement expressly identifies a subscription as recurring, you authorize the applicable payment provider to charge the disclosed fees and applicable taxes according to the disclosed billing frequency until the subscription is canceled or otherwise ends.
Where a recurring plan is offered, Trusti will provide cancellation options and notices required by applicable law.
Unless expressly stated otherwise:
- submitting payment does not guarantee permanent pricing;
- early-access pricing does not guarantee future pricing;
- refunds are governed by the terms disclosed at purchase and applicable law; and
- cancellation ordinarily stops future renewal rather than retroactively canceling completed billing periods, except where applicable law or the applicable purchase terms provide otherwise.
Founding Pilot and organizational engagements
Submitting a Trusti Business Founding Pilot application does not guarantee selection, acceptance or participation.
If GPGA and an organization decide to proceed, the parties may establish the organizational scope, timeline, participants or authorized roles, deliverables, pricing if applicable, responsibilities, confidentiality terms, data-handling requirements and other applicable conditions through a proposal, pilot agreement, order form or other written agreement.
The Founding Pilot is structured according to the organization and agreed scope rather than a guaranteed number of participants.
If a signed pilot or organizational agreement conflicts with these Terms regarding the engagement it governs, that agreement controls for that subject matter.
Third-party services
Trusti may use or connect with third-party providers supporting functions such as hosting and infrastructure, authentication, communications, analytics, authorized data signals, payment processing and other operational services.
Some Trusti experiences may also provide links to third-party websites or services. Third-party services outside GPGA’s control may be governed by their own terms and privacy notices.
GPGA is not responsible for the independent conduct of third parties outside GPGA’s reasonable control, subject to rights and responsibilities that cannot lawfully be excluded.
Suspension and termination
GPGA may suspend, restrict or terminate access when reasonably necessary because of:
- a security threat;
- unauthorized or unlawful activity;
- misuse of Trusti;
- violation of these Terms;
- nonpayment of amounts properly due;
- risk to users, GPGA or third parties;
- legal or regulatory requirements; or
- discontinuation of a service.
You may stop using Trusti at any time.
Termination does not eliminate obligations or rights that by their nature should survive, including provisions concerning intellectual property, payment obligations already incurred, limitations, dispute provisions and other surviving obligations.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSTI SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
GPGA disclaims implied warranties to the extent they may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
GPGA does not warrant that:
- every signal or source will always be available;
- every Trusti output will be complete or error-free;
- a Score or other output will remain unchanged;
- an output will be suitable for a particular decision; or
- Trusti will operate without interruption.
Nothing in these Terms excludes warranties, protections or remedies that cannot lawfully be excluded.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GPGA and its affiliates, officers, directors, employees and providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, goodwill, opportunities or data, arising from or relating to Trusti.
To the maximum extent permitted by law, GPGA’s aggregate liability for claims relating to an affected Trusti service will not exceed the greater of US$100 or the amount you paid GPGA for the affected service during the 12 months preceding the event giving rise to the claim.
These limitations do not apply to liability that cannot lawfully be limited or excluded. Some jurisdictions provide rights or remedies that may override portions of this section.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify and hold GPGA harmless from third-party claims, losses, liabilities and reasonable expenses arising from your unlawful or unauthorized use of Trusti; information you submit without lawful authority; your violation of these Terms; or your infringement or violation of another person’s rights.
This section does not require indemnification where prohibited by applicable law.
Governing law, disputes and changes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules, while preserving mandatory consumer protections that cannot lawfully be waived.
Unless applicable law requires otherwise, state and federal courts located in Delaware will have jurisdiction over disputes relating to these Terms.
Before filing a claim, the parties agree to attempt good-faith informal resolution for 30 days by contacting the other party.
Legal notices to GPGA may be sent to legal@trustiscore.com.
Changes to these Terms
We may update these Terms as Trusti products, practices or legal requirements evolve. We will post the revised version and identify its effective date.
For material changes, we may provide additional notice through Trusti, by email or through another reasonable method.
Where applicable law or the nature of a change requires additional affirmative consent, GPGA will seek that consent rather than relying solely on continued use.
